Terms and Conditions

Our Policy

These Terms and Conditions set out the terms on which SportSense agrees to act. It sets out our statutory obligations and identifies your responsibilities to us.

We aim to present this information in a clear and fair way. Please contact us immediately if there is anything in these Terms and Conditions that you disagree with or do not understand.

1. Definitions

  1. Booking Form” means the form relating to the booking or re-booking of the Participant for a Half-term or Term.
  2. Class(es)” means a series recurring sessions on the same time and day of the week.
  3. Camp” or “Workshop” means a one-off session on a given day.
  4. Coach(es)” means the individual(s) engaged by us to teach Classes. Whilst every effort will be taken to maintain the consistency of the Coaches during the Half-term or Term, we retain the right to change the coaching staff where necessary.
  5. Fees” means the value chargeable to attend Classes for a Half-term or
  6. Participant” means the child who is attending or who is booked on to a Class organised by us whose details are specified by the you on the Booking Form.
  7. Premises” means the Premises where the Classes take place.
  8. Half-term” and “Term” means the agreed dates as described under “Class Dates” on the Website.
  9. Terms & Conditions” means the terms and conditions set out in this document and any special terms and conditions agreed in writing by us and

  11. Website” means the Website at SportSense.org.uk
  12. You” and “your” means the entity (i.e. individual, school, business etc) who has engaged our services and is responsible for the payment of Fees and who is the contracting party to this contract and who shall be responsible for compliance with these Terms & Conditions.

2. Acceptance

  1. All agreements and issues relating to the teaching of the Classes, Camps or Workshops by us to the Participant and the on-going communication with Coaches and Staff employed by us are subject to the Terms & Conditions to the exclusion of all others.
  2. No variation or addition to the Terms & Conditions shall be binding unless agreed in writing by us and you.
  3. These Terms & Conditions shall be deemed to be accepted by you once the box is ticked on the Booking Form and confirmation of payment of Fees has been received by us. Attendance at any session is also acceptance.
  4. We may cancel this contract at any time before the Participant commences a Half-term or Term, for any reason whatsoever. This also applies to camps and workshops. We shall not be responsible for any loss or damage whatsoever arising from such cancellation but will refund Fees paid for the remaining Classes in the Term or Camps and Workshops.

3. Your Obligation

  1. You warrant that the information provided on the Booking Form is accurate and up to date in all respects at the point of booking. Any changes will immediately be sent by you to us.
  2. It is your responsibility to inform us of any special medical conditions at the point of booking. This includes behavioral disorders.
  3. We ask that you brief each Coach on any medical procedure or medicines to be provided during our classes, camps or workshops.
  4. The Participant and/or you must not attend any Class whilst suffering from any serious illness or contagious disease or anything similar thereto.
  5. We shall have the sole right to exclude the Participant and/or you either permanently or for such period as we shall (in its entire discretion) determine if deemed necessary for the safety and wellbeing of other Participants or Parents.
  6. It is your responsibility for ensuring that clothing and footwear is suitable for the extremes of weather (hot and cold) and that protection such as sunscreen is supplied by you. We are unable to provide protection in the form of sunscreen or hats.
  7. You have the responsibility to ensure supplies of adequate hydration and snacks/meals to sustain energy.
  8. You must ensure footwear is suitable for hard surfaces and rigorous changes of direction.
  9. Jewelry is not allowed during netball for safety reasons, so we ask that this be removed prior to attending. We take no responsibility for the loss or damage to property in this respect. Players may hurt others with sharp jewelry or items where fingers may get caught such as bracelets or watch bands.
  10. Earrings pose a danger to ear drum puncture or being torn off so we ask for these to be removed.
  11. We may ask a player to sit out if they aren’t compliant with the above for the safety of all participants.

4. Limitation of Liability

  1. You agree that any claim made against us will be made in writing within 30 days of the incident taking place and failure to report in writing within this time will negate any such claim.
  2. The maximum aggregate liability for us to the Participant and /or you will not exceed the Fees.
  3. Neither us nor any Coach, coaches assistant nor any employee, agent or other representative accepts responsibility in respect of loss, damage or expense incurred by a Participant or you arising directly or indirectly or in any way connected with the attendance of the Participant and you at Classes (or any Class) or any other act or omission on the part of us, its Coaches, coaches assistants, employees, agents and/or representatives.
  4. All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or excluded liability for death or personal injury caused by the negligence of us, our Coaches, coaches assistants, employees, agents and/or representatives or affects the statutory rights of you or Participant.

5. Fees & Payment

  1. You shall pay the Fees for the Half-term or Term to us prior to the Participant commencing a Half-term or Term. Prior meaning by the start time of the first session.
  2. Late payment will incur a fee of £5 if payment is not made prior (See meaning of prior in 6.1) to the start of the Half-term or Term. This will be £10 if payment extends beyond the end of the Half-term or Term. Failure to pay at any time may also result in the Participant being asked to cease attendance.  We would prefer not to charge late Fees but much time and expense can go into payment reminders and tracking.   3. Full Half-term or Term Fees are due up to a third of the way through a Half-term or term. They may be pro-rated at our discretion if joining after this time as a new Participant that has not previously attended classes (i.e. takes a trial session).
  4. A trial session is offered. This will be at no charge if the Participant does not join the classes. If the Participant wants to join, the trial session is regarded as the first class of that Half-term or Term.
  5. Fees are set on the assumption that there will be one cancellation due to weather over a Term (or Two Half-terms). Any refund for a classes cancellation beyond this will be in the form of a credit for the next Half-term or Term.
  6. Fees are also set on the assumption that a Participant’s attendance may not be 100%. Refunds will not be given for absences.
  7. The Half term or term Fees are not refundable in any circumstances other than with our written consent. Please contact us if you feel there are extenuating circumstances.
  8. Camp or Workshop Fees are due prior to the start of the Camp. To secure a place these must be paid 48 hours prior to commencement. Please check if seeking a place within 48 hours to ensure we have spare capacity.
  9. A full refund on a camp or workshop will apply if notice is given prior to the commencement of the Camp. A partial refund up to 50% may be given if notified after the commencement of the camp. No refund will be given if the notification of non-attendance was after the end of the camp.
  10. A refund will not be given if a Camp Participant is late or, chooses or is asked to leave once the camp has commenced.
  11. In the event of poor weather at a Camp, a partial refund may be given but entirely at our discretion
  12. A full refund will be given if a camp is cancelled prior to commencing.

6. General

  1. By agreeing to these terms and conditions you consent that the data provided (non-financial) can be shared within us.
  2. You shall indemnify and keep indemnified us against all loss (including loss of profit), liability, cost and expenses which we may incur directly or indirectly as a consequence of any action or inaction of you and/or Participant.
  3. Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.
  4. The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all such obligations.
  5. These terms and conditions constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.
  6. This contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
